A Liminar foi concedida nesta sexta-feira \u00e0s 22h11 minutos. A Prefeitura Informou que vai recorrer da decis\u00e3o.<\/p>\n\n\n\n<p>Na a\u00e7\u00e3o est\u00e3o arrolados como r\u00e9us o Munic\u00edpio de Ouro Preto, a Sony Music Entertainment Brasil Ltda, GH Music Produ\u00e7\u00e3o Musical Editora e Gravadora Ltda, Dilson Scher Neto e o Instituto do Patrim\u00f4nio Hist\u00f3rico e Art\u00edstico Nacional (Iphan)<\/p>\n\n\n\n<p>Da decis\u00e3o se destaca que os preju\u00edzos da produ\u00e7\u00e3o n\u00e3o se sobrep\u00f5em ao princ\u00edpio da precau\u00e7\u00e3o. \u201cNo caso em tela, n\u00e3o se desconhece que a determina\u00e7\u00e3o da suspens\u00e3o do show causar\u00e1 preju\u00edzos aos seus organizadores; todavia, o referido preju\u00edzo, al\u00e7ado \u00e0 esfera patrimonial financeira, n\u00e3o prevalece ante o princ\u00edpio da precau\u00e7\u00e3o, com o fim de salvaguardar o patrim\u00f4nio hist\u00f3rico nacional. Demais disso, de um lado est\u00e3o os interesses sociais; de outro, os individuais. \u00c9 um mecanismo que distingue aqui e ali a predomin\u00e2ncia do interesse social sobre o particular.\u201d<\/p>\n\n\n\n<p>Al\u00e9m de parar a divulga\u00e7\u00e3o, a decis\u00e3o tamb\u00e9m define a suspens\u00e3o da montagem das estruturas sob o risco de desobedi\u00eancia e multa de R$ 500 mil. Dr. Jo\u00e3o Batista tamb\u00e9m intima a Pol\u00edcia Militar para que n\u00e3o permita a realiza\u00e7\u00e3o. \u201c\u00e0 Pol\u00edcia Militar que adote todas as medidas necess\u00e1rias, em observ\u00e2ncia \u00e0s suas respectivas atribui\u00e7\u00f5es legais, no sentido de impedir a realiza\u00e7\u00e3o do evento \u201cDiferent\u00e3o 2\u201d na Pra\u00e7a Tiradentes no dia 10\/09\/2023, sem preju\u00edzo de responderem os seus representantes legais por crime de desobedi\u00eancia e outros crimes ambientais que se verificarem no local.\u201d<\/p>\n\n\n\n<p><\/p>\n\n\n\n<p class=\"has-medium-font-size\">Outro lado &#8211; Procurada pela reportagem, a Assessoria de Imprensa da Prefeitura informou que:<\/p>\n\n\n\n<p>\u201cA Prefeitura de Ouro Preto esclarece que toda a documenta\u00e7\u00e3o para a realiza\u00e7\u00e3o da grava\u00e7\u00e3o do DVD \u201cDiferent\u00e3o 2\u201d, agendada para o dia 10 de setembro, na Pra\u00e7a Tiradentes, em Ouro Preto, j\u00e1 foi enviada aos \u00f3rg\u00e3os competentes, tendo obtido o aval do Corpo de Bombeiros que atestou as condi\u00e7\u00f5es de seguran\u00e7a em rela\u00e7\u00e3o \u00e0 realiza\u00e7\u00e3o do evento.<\/p>\n\n\n\n<p>Neste s\u00e1bado, 9 de setembro, fomos surpreendidos com decis\u00e3o da Justi\u00e7a Federal determinando a suspens\u00e3o do evento.
